Terms & Conditions

These terms are an agreement between you and GaiaLight Technology ("we", "us") covering your use of the Kalori mobile app and anything it connects to. By installing or using Kalori you accept them. If you do not accept them, do not use the app.

1. Who may use Kalori

You must be at least 13 years old. If you are between 13 and 18, the app will only ever suggest a maintenance calorie intake — it will not suggest a deficit or a surplus. You are responsible for the accuracy of the profile information you enter; the calorie target the app calculates depends entirely on it.

2. Your account

You sign in with Google. You are responsible for keeping access to that Google account secure, and for everything done through your Kalori account. Tell us straight away if you believe someone else has used it.

One person, one account. Do not create accounts in bulk, and do not sell or transfer your account to anyone else.

3. Crystals

Crystals are a virtual item inside the app. They are spent to have a meal analysed, and you can get them in several ways: a starting allocation when you first sign up, watching an advertisement, buying them through the app store, and occasional bonuses such as reaching a streak.

• Crystals have no cash value. They are a limited, personal, non-transferable licence to use a feature of the app — not property, not currency, and not redeemable for money.
• Crystals cannot be transferred between accounts, sold, or exchanged for anything outside the app.
• If a meal analysis fails for a reason on our side, the crystal it cost is returned to you automatically.
• Unused crystals are lost when your account is deleted, and we do not compensate for them.
• We may change what a feature costs in crystals, how many crystals a purchase yields, or how crystals are earned. Where a change is significant we will tell you in the app beforehand.

4. Purchases and refunds

Crystals are bought through Google Play. That purchase is a transaction between you and Google, under Google's payment terms — we never receive or store your card details.

Refunds are handled by Google Play, not by us, and are subject to Google's refund policy. If Google refunds or reverses a purchase, we remove the corresponding crystals from your balance. If that leaves you having already spent them, your balance may go to zero but we will not pursue you for the difference.

Prices are shown in the app before you buy and may change over time. Taxes are handled by Google Play at checkout.

5. Advertising

Kalori shows advertisements through Google AdMob, including advertisements you may choose to watch in exchange for crystals. We do not control what those advertisements contain and we are not responsible for them. Attempting to manipulate the ad reward system — automation, emulators, tampering with the app — is a breach of these terms.

6. What you may not do

• Reverse engineer, decompile, or tamper with the app, or attempt to bypass its security or integrity checks.
• Access our API by any means other than the official app, or run automated tools against it.
• Submit content that is unlawful, or that infringes someone else's rights.
• Attempt to obtain crystals other than through the means the app provides.
• Interfere with the service, or with anyone else's use of it.

7. Content you submit

Meal photos and descriptions you submit remain yours. You grant us a licence to process, store and transmit them for the sole purpose of running the service — producing your calorie estimate, storing your history, and improving accuracy where you have consented to that. This licence ends when you delete the content or your account, subject to the retention described in our Privacy Policy.

You confirm that you have the right to submit whatever you upload.

8. Availability

We aim to keep Kalori running, but we do not guarantee it will be available without interruption. We may suspend it for maintenance, change or remove features, or discontinue it entirely. If we discontinue the service we will give reasonable notice in the app where we can.

9. Ending your use

You may stop using Kalori at any time and delete your account from within the app or from our account deletion page. Deletion is described in the Privacy Policy.

We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we reasonably believe your use is fraudulent or is harming the service or other users. Where it is reasonable to do so, we will tell you why.

10. Disclaimers

Kalori is provided "as is". To the fullest extent the law allows, we make no warranties of any kind about it, including that calorie or nutrient estimates will be accurate, that the app will meet your requirements, or that it will be error-free.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect or consequential loss, loss of data, loss of profit, or any health outcome arising from your reliance on estimates the app produced.

Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or MYR 100.

12. Changes to these terms

We may update these terms. When we do we will change the "last updated" date above, and where the change is material we will notify you in the app. Continuing to use Kalori after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising from them. Nothing here removes any consumer right you have under the law of the country you live in.
